• You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account.
• You agree to provide accurate and current information when registering and to keep it up to date.
• You must notify us promptly at support@searoutesnav.com of any unauthorized use of your account.

Use of the Services

Subject to these Terms and any applicable plan limits, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your own lawful business purposes. You agree that you will not:

• Resell, sublicense, redistribute, or make the Services or data available to competitors of Searoutesnav.
• Exceed the request limits, rate limits, or usage quotas associated with your plan.
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Services or their underlying systems.
• Use the Services in a way that infringes the rights of others or violates any applicable law or regulation.
• Introduce malware, or otherwise disrupt, damage, or impair the Services.

API Access & Fair Use

Access to our APIs is subject to the plan you subscribe to. We may throttle, suspend, or limit access where usage exceeds agreed limits or where we reasonably believe use is abusive, fraudulent, or harmful to the Services or other users.

Fees & Payment

• Paid plans are billed according to the pricing and billing cycle presented at the time of purchase.
• Unless stated otherwise, fees are exclusive of applicable taxes, which are your responsibility.
• Except where required by law, fees already paid are non-refundable.
• We may change pricing on a going-forward basis; changes will not affect the current paid billing period.

Intellectual Property

The Services, including all software, data, content, trademarks, and design, are and remain the property of Searoutesnav and its licensors. These Terms do not grant you any ownership rights. You may not use our name, logos, or trademarks without our prior written consent.

Data Accuracy & Availability

Route calculations, distances, transit times, port data, and CO₂ emissions figures are provided as estimates. We do not guarantee their accuracy or completeness, and they must not be relied upon for vessel navigation or safety-critical decisions. Please see our Disclaimer for details. We aim for high availability but do not guarantee that the Services will be uninterrupted or error-free.

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Searoutesnav and The Freight Report LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Services. Our total aggregate liability under these Terms shall not exceed the amounts you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Searoutesnav, The Freight Report LLC, and their officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Services or your breach of these Terms.

Suspension & Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or if we are required to do so by law. You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply.

Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York, NY.

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
